The Washington  State Bar Association is responsible for the bar exam. The Examiners do not release their local content to the public on-line, although it is possible to buy some of it. This is an interesting exam because it has only local content. The Washington Bar exam does not include any of the multistate exams (such as the MBE and MPRE) developed by the National Conference of Bar Examiners.

The Washington Bar exam, a 2¼-day exam, consists of

  • 18 Washington essay questions covering substantive law, given over 2 days, and
  • 6 Washington essay questions covering the Washington Rules of Professional Conduct, given on the last day.

Each question is worth 10 points, and the successful applicant must achieve 70% on both portions: at least 126 points on the substantive portion and at least 42 points on the professional responsibility portion.
The Washington bar exam covers the following areas of law:

  • administrative law
  • business law (corporations, partnerships, LLCs) (business associations)
  • commercial transactions, consisting of UCC Articles 1 (general provisions), 2 (sales), 3 (negotiable instruments/commercial paper), 4 (bank deposits and collections), and 9 (secured transactions)
  • constitutional law (federal and Washington)
  • contracts
  • criminal law, including substantive crimes and defenses
  • family law
  • Indian law
  • professional conduct (Washington Rules of Professional Conduct)
  • property, real and personal, including community property, conveyancing, financing, leasing use and zoning
  • torts
  • trial procedure, including evidence and procedure before, during, and after civil and criminal trials (evidence, civil procedure, criminal procedure, lawyering process)
  • wills, probate, and trusts.
